1. About These Terms
These Terms of Service govern your use of the Ask ECE platform operated by Ask ECE Pty Ltd. By creating an account or using the Platform, you agree to these Terms. They are governed by the laws of Victoria and the Commonwealth of Australia, including the Australian Consumer Law.
2. The Platform
Ask ECE is a professional support platform for Australian ECE professionals, providing an AI knowledge engine, NQS Toolkit, A&R preparation, Learning Story Generator, Student Hub, Pay Calculator, Jobs Board, Child Portfolio, Policy Template Library, and professional resources.
3. Accounts
You must provide accurate registration details and keep your credentials confidential. You must be at least 18 years of age to create an account. Notify us at hello@askece.com.au of any unauthorised access.
4. Subscriptions, Credits & Payments
The Platform uses a credit system. New accounts receive 4 free starter credits. Paid plans are billed monthly in AUD inclusive of GST. Monthly credits reset on renewal and do not carry over. You may cancel anytime, effective at the end of the billing period. We provide 30 days' notice of price changes. No refunds for unused credits except as required by Australian Consumer Law.
4A. Courses & Digital Products
Where you purchase or access a course, toolkit, downloadable resource, or other digital product (each a “Digital Product”), it is licensed to you, not sold. You receive a non-exclusive, non-transferable, revocable licence to use it for your own professional learning or within your own service; ownership and intellectual property remain with Ask ECE Pty Ltd. You may use, print, and adapt a purchased resource for your own service, but you must not share access, resell, redistribute, publish, sublicense, or use it to deliver paid training to third parties without our written permission. Digital Products are delivered electronically; course materials are general professional learning and are not an accredited qualification unless stated, and any certificate is a record of participation only. Because Digital Products are accessed immediately, we do not provide change of mind refunds once you have accessed, downloaded, or commenced a Digital Product. This does not limit your rights under the Australian Consumer Law if a Digital Product has a major failure or is not as described.
5. AI-Generated Content: Important Disclaimer
All AI-generated content is for general informational purposes only and does not constitute legal, regulatory, compliance, financial, employment, or professional advice. It may be inaccurate, incomplete, or outdated. You must review, verify, and apply your own professional judgement before acting on or sharing any AI-generated content. Learning Stories, NQS assessments, and QIP goals must be reviewed and personalised by a qualified ECE professional before use. The Pay Calculator provides indicative minimum rates only, verify with Fair Work Australia. Ask ECE disclaims all liability for reliance on AI-generated content.
Policy templates generated by the Platform are drafts and a guide only. They are not legal advice and are not legally binding. Review and adapt each template for your service, check it against the current National Law, National Regulations and your state or territory requirements, and consult a qualified lawyer before relying on it. Each generated template includes this disclaimer, which must not be removed.
6. Acceptable Use
You agree not to: violate any law or professional obligation; upload personally identifiable information about children (full names, photos, health information); reverse engineer or scrape the Platform; share account credentials; resell AI content without consent; or misrepresent AI content as your own original work in academic or professional contexts.
7. Intellectual Property
The Platform and its content are owned by or licensed to Ask ECE Pty Ltd. You retain ownership of content you submit, granting us a licence to process it solely to provide the services. AI output is for your personal or professional use; you may not resell or sublicense it.
8. Privacy
Our Privacy Policy explains how we handle your information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the preceding 12 months. We are not liable for indirect or consequential damages. Nothing excludes rights under the Australian Consumer Law that cannot be excluded.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a remedy.
11–12. Changes & Termination
We may update these Terms and will notify you of material changes. We may suspend or terminate accounts that breach these Terms. You may close your account anytime.
